Terms of Service
By using this service, you agree to comply with the Terms of Service outlined below.
Article 1 (Purpose)
These Terms of Service are established to define the rights, obligations, and responsibilities between Kumkang Energy Solution Co., Ltd. (hereinafter referred to as the "Company"), an e-commerce business operator, and users in relation to the internet-based services (hereinafter referred to as the "Services") provided through the Company’s website and online store (hereinafter referred to as the "Mall").
Article 2 (Definitions)
The term "Mall" refers to the virtual business site established by Geumgang Energy Solution Co., Ltd. to provide goods or services (hereinafter referred to as "Products") to users through information and communication equipment such as computers. The term also includes the business operator managing the Mall.
The term "User" refers to anyone who accesses the Mall and receives the services provided by the Mall in accordance with these Terms, including both members and non-members.
The term "Member" means a person who has registered as a member of the Mall and is continuously provided with the services offered by the Mall.
The term "Non-Member" refers to a person who uses the services provided by the Mall without registering as a member.
Article 3 (Display, Explanation, and Amendment of the Terms and Conditions)
The Mall shall display these Terms and Conditions, along with the company name, name of the representative, business address (including the address for customer complaints), telephone number, fax number, email address, business registration number, e-commerce registration number, and personal information manager, in a way that is easily accessible by users on the main page of the website. The full terms may be linked separately for viewing.
Before users agree to these Terms, the Mall shall provide a separate pop-up or linked screen to ensure that users fully understand important provisions such as cancellation policies, delivery responsibilities, and refund conditions.
The Mall may amend these Terms to the extent that such amendments do not violate relevant laws such as the Act on Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, the Basic Act on Electronic Documents and Transactions, the Electronic Financial Transactions Act, the Digital Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Door-to-Door Sales Act, the Framework Act on Consumers, and other applicable laws.
When amending these Terms, the Mall shall specify the effective date and reasons for the amendment, and notify users by displaying the current and amended terms on the Mall's main page for at least 7 days prior to the effective date. If the amendment is unfavorable to users, a notice period of at least 30 days shall be provided. In such cases, the Mall shall clearly compare the current and amended terms for easy understanding.
The amended Terms shall apply only to contracts entered into after the effective date. For contracts made before the amendment, the previous Terms shall remain in effect unless the user agrees to apply the amended Terms during the notice period and the Mall consents to it.
Any matters not specified in these Terms or any interpretation thereof shall be governed by applicable laws including the Act on Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, guidelines set by the Fair Trade Commission, and general commercial practices.
Article 4 (Provision and Modification of Services)
The Mall provides the following services:
Provision of information regarding products or services and conclusion of purchase contracts
Delivery of products or services under concluded contracts
Other services as determined by the Mall
In the event of product shortages or changes in technical specifications, the Mall may modify the content of products or services to be provided under future contracts. In such cases, the Mall shall clearly announce the updated details and effective date where the original product or service information was posted.
If the Mall must change the content of a service already contracted with a user due to reasons such as shortages or technical changes, the Mall shall notify the user immediately at an address where notification is possible.
In such cases, the Mall shall compensate the user for any damages incurred. However, this shall not apply if the Mall proves there was no intention or negligence on its part.
Article 5 (Service Interruption)
The Mall may temporarily suspend the provision of services due to reasons such as maintenance, replacement, or failure of information and communication systems (e.g., computers), or interruption of communications.
The Mall shall compensate users or third parties for any damages caused by the temporary suspension of service under paragraph 1. However, this shall not apply if the Mall proves there was no willful misconduct or negligence.
In the event that the Mall is unable to continue providing services due to business closure, business type conversion, merger with another company, or other reasons, the Mall shall notify users in accordance with Article 8 and compensate consumers according to the terms originally offered by the Mall. If no such compensation standards were announced, the Mall shall compensate users by converting accumulated points or credits into their equivalent cash or in-kind value usable within the Mall.
Article 6 (Membership Registration)
A user may apply for membership by filling out the registration form provided by the Mall and expressing agreement with these Terms and Conditions.
The Mall shall approve the membership application unless the applicant falls under any of the following:
The applicant has previously lost membership under Article 7, Paragraph 3 of these Terms. However, if three years have passed since disqualification and the Mall has approved re-registration, an exception may be made.
The application contains false information, omissions, or errors.
The Mall deems the registration technically problematic or significantly disruptive.
The membership agreement is deemed effective when the Mall’s approval reaches the user.
If any registered information changes, the member must notify the Mall within a reasonable period through a method such as modifying the member profile.
Article 7 (Membership Termination and Disqualification)
A member may request to withdraw from membership at any time, and the Mall shall process the withdrawal immediately.
The Mall may restrict or suspend membership if the member falls under any of the following:
Registration with false information during sign-up.
Failure to pay for goods or services purchased via the Mall or any other debts related to the use of the Mall.
Obstructing the use of the Mall by others or illegally using their information, thereby disrupting e-commerce order.
Engaging in illegal acts or activities that violate public order and morals through the Mall.
If the same violation is repeated twice or more, or is not corrected within 30 days after restriction/suspension, the Mall may terminate the member’s qualifications.
If the Mall terminates a member’s qualification, the member’s registration shall be deleted. In this case, the Mall will notify the member and provide at least 30 days’ notice, allowing the member an opportunity to appeal before deletion.
Article 8 (Notices to Members)
The Mall may provide notices to members via the email address designated in advance through agreement between the Mall and the member.
For notices addressed to an unspecified number of members, the Mall may substitute individual notice by posting such notice on the Mall's bulletin board for at least one week. However, matters that have a significant impact on a specific member’s transaction will be individually notified.
Article 9 (Purchase Application and Consent to Provide Personal Information)
Users of the Mall shall apply for purchases through the following or similar procedures. The Mall must clearly provide the following information to users before they make a purchase:
Search and selection of products or services
Entry of recipient's name, address, phone number, email address (or mobile phone number), etc.
Confirmation of important matters such as terms and conditions, limitations on withdrawal rights, delivery fees, and installation charges
Indication of agreement to the Terms and Conditions and confirmation (or rejection) of the above items (e.g., via mouse click)
Submission of the purchase application and agreement to confirmation by the Mall
Selection of payment method
If the Mall needs to provide a purchaser’s personal information to a third party, it must inform the purchaser and obtain consent by clearly stating the following:
The recipient of the personal information
Purpose of the recipient’s use of the information
Specific personal information to be provided
Period of retention and use of the information by the recipient
(The same applies in the event of any changes to the previously agreed items.)
If the Mall outsources the handling of the purchaser’s personal information to a third party, it must inform the purchaser and obtain consent by specifying the following:
The recipient of the outsourced work
Details of the outsourced work involving personal information handling
However, if such outsourcing is necessary for fulfilling the service contract and is related to improving the purchaser’s convenience, the Mall may provide notice through its privacy policy in accordance with the Act on Promotion of Information and Communications Network Utilization and Information Protection, without undergoing separate notice or consent procedures.
Article 10 (Formation of Contract)
The Mall may refuse to accept a purchase application under Article 9 in any of the following cases. However, when concluding a contract with a minor, the Mall must inform the minor that the contract can be canceled by the minor or their legal representative if the legal representative’s consent has not been obtained:
When the application contains false information, omissions, or errors
When a minor attempts to purchase goods or services prohibited by the Juvenile Protection Act, such as tobacco or alcohol
When the acceptance of the purchase application is technically difficult for the Mall
The contract is considered concluded at the moment when the Mall’s acceptance reaches the user in the form of a notification of receipt confirmation as stated in Article 12, Paragraph 1.
The Mall’s notification of acceptance shall include confirmation of the user’s purchase application, availability of the goods or services, and information about any correction or cancellation of the purchase application.
Article 11 (Payment Methods)
Payment for goods or services purchased from the Mall may be made by any of the following available methods. However, the Mall may not charge any additional fees or commissions for the user’s chosen payment method:
Various account transfers such as phone banking, internet banking, or mail banking
Payment by prepaid cards, debit cards, credit cards, or other types of cards
Online bank transfer without a passbook
Payment via electronic money
Payment upon receipt of goods
Payment by points or mileage granted by the Mall
Payment by gift certificates contracted or recognized by the Mall
Other electronic payment methods
Article 12 (Receipt Confirmation Notification, Changes, and Cancellation of Purchase Application)
When a user submits a purchase application, the Mall shall send a receipt confirmation notification to the user.
Upon receiving the receipt confirmation notification, the user may request changes or cancellation of the purchase application if there is a discrepancy in their intention. If such a request is made before shipment, the Mall shall promptly process the request. However, if payment has already been made, the withdrawal and refund provisions under Article 15 shall apply.
Article 13 (Supply of Goods, etc.)
Unless otherwise agreed regarding the timing of supply, the Mall shall take necessary actions such as ordering, manufacturing, and packaging to deliver the goods within 7 days from the date the user places an order. However, if the Mall has already received all or part of the payment for the goods, it shall take such actions within 3 business days from the date the payment was received. At this time, the Mall shall take appropriate measures to allow the user to check the supply process and progress of the goods.
The Mall shall specify the delivery method, the party responsible for delivery costs by method, and the delivery period for the goods purchased by the user. If the Mall exceeds the agreed delivery period, it shall compensate the user for any damages caused thereby. However, this does not apply if the Mall proves that there was no intention or negligence.
Article 14 (Refunds)
If the Mall cannot deliver or provide the goods due to reasons such as stockouts, it shall promptly notify the user of the reason and refund the payment within 3 business days from the date the payment was received, or take necessary actions for the refund.
Article 15 (Withdrawal of Contract, etc.)
Users who have entered into a purchase contract with the Mall may withdraw from the contract within 7 days from the day they receive the written contract details as stipulated in Article 13, Paragraph 2 of the Consumer Protection Act in Electronic Commerce, etc. (If the supply of goods is delayed beyond the receipt of the written document, the withdrawal period starts from the day the goods are received or the supply begins). However, if there are other provisions regarding withdrawal under the Consumer Protection Act in Electronic Commerce, those provisions shall apply.
Users cannot return or exchange goods in the following cases after receiving the goods:
When the goods are lost or damaged due to reasons attributable to the user (however, withdrawal is allowed if packaging is damaged only to check the contents)
When the value of the goods significantly decreases due to use or partial consumption by the user
When the value of the goods significantly decreases over time to the extent that resale is difficult
When the packaging of goods that can be duplicated with the same performance is damaged
If the Mall did not clearly indicate or provide measures to inform users of the restrictions on withdrawal as specified in Paragraph 2, the user’s withdrawal rights shall not be restricted.
Notwithstanding Paragraphs 1 and 2, if the goods differ from the advertised or contract terms, users may withdraw within 3 months from receiving the goods, or within 30 days from the date the user became aware or could have become aware of such facts.
Article 16 (Effects of Withdrawal of Contract, etc.)
When the Mall receives the returned goods from the user, it shall refund the payment already received for the goods within 3 business days. If the Mall delays the refund, it shall pay delayed interest calculated by multiplying the delay period by the delayed interest rate prescribed in Article 21-3 of the Enforcement Decree of the Act on Consumer Protection in Electronic Commerce.
When refunding the payment, if the user paid by credit card, electronic money, or similar payment methods, the Mall shall immediately request the business entity providing the payment method to stop or cancel the payment claim.
The user shall bear the cost necessary for the return of goods in case of withdrawal of contract, etc. The Mall shall not claim penalties or damages from the user due to withdrawal. However, if the withdrawal is due to the goods being different from the advertised or contracted content, the Mall shall bear the cost of returning the goods.
When the user pays shipping costs upon receiving the goods, the Mall shall clearly indicate who bears the shipping cost in case of withdrawal, so that the user can easily understand.
Article 17 (Personal Information Protection)
The Mall collects only the minimum personal information necessary to provide services when collecting user personal data.
The Mall does not collect information necessary for fulfilling a purchase contract before membership registration. However, if identity verification is required prior to purchase contract to fulfill legal obligations, the Mall may collect a minimum amount of specific personal information.
When collecting and using personal information, the Mall shall notify the user of the purpose and obtain consent.
The Mall shall not use collected personal information for purposes other than those notified. If new usage purposes arise or information is to be provided to third parties, the Mall shall notify and obtain consent from the user at the stage of use or provision. Exceptions apply as stipulated by relevant laws.
When obtaining user consent as required in Paragraphs 2 and 3, the Mall must clearly indicate or notify the identity of the personal information manager (affiliation, name, phone number, and contact information), purposes of information collection and use, and details about providing information to third parties (recipients, purpose, and content of information), as stipulated in Article 22-2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection. Users may withdraw consent at any time.
Users may request to view or correct their personal information held by the Mall at any time. The Mall must promptly take necessary actions. If a correction is requested, the Mall shall not use the relevant personal information until corrected.
To protect personal information, the Mall shall limit the number of personnel handling user information. The Mall is fully responsible for any damage to users caused by loss, theft, leakage, unauthorized provision to third parties, or alteration of personal information, including credit card and bank account details.
The Mall or any third party receiving personal information must promptly destroy such data once the purpose of collection or provision has been achieved.
The Mall shall not set pre-checked consent boxes for collecting, using, or providing personal information. If the user refuses consent, the Mall shall clearly specify which services are limited. Refusal of consent for non-essential information shall not restrict membership registration or service provision.
Article 18 (Obligations of the Mall)
The Mall shall not engage in any acts prohibited by law or this agreement, or acts contrary to public order and morals, and shall endeavor to continuously and stably provide goods and services as stipulated in these terms.
The Mall shall establish a security system to protect users’ personal information (including credit information) so that users can safely use the internet service.
If the Mall causes damages to users by engaging in unfair labeling or advertising acts as defined in Article 3 of the Act on Fair Labeling and Advertising regarding goods or services, the Mall shall be liable to compensate for such damages.
The Mall shall not send commercial advertising emails for profit purposes that users do not wish to receive.
Article 19 (User’s Responsibilities for ID and Password)
Except for cases specified in Article 17, the management responsibility for ID and password lies with the member.
Members shall not allow third parties to use their ID and password.
If a member recognizes that their ID and password have been stolen or are being used by a third party, the member shall immediately notify the Mall and follow the Mall’s instructions.
Article 20 (User Obligations)
Users shall not engage in the following actions:
Registering false information at the time of application or change.
Using another person’s information without authorization.
Altering information posted by the Mall.
Transmitting or posting information (such as computer programs) other than the information set by the Mall.
Infringing copyrights or other intellectual property rights of the Mall or third parties.
Damaging the reputation or interfering with the business of the Mall or third parties.
Publicly disclosing or posting obscene, violent messages, images, sounds, or other information contrary to public order and morals on the Mall.
Article 21 (Copyright Ownership and Use Restrictions)
Copyright and other intellectual property rights for works created by the Mall belong to the Mall.
Users shall not reproduce, transmit, publish, distribute, broadcast, or use for commercial purposes, or allow third parties to use, any information obtained through the Mall that is subject to intellectual property rights of the Mall without prior consent from the Mall.
When the Mall uses copyrights owned by users according to an agreement, it shall notify the relevant users.
Article 22 (Dispute Resolution)
The Mall shall establish and operate a compensation handling organization to reflect legitimate opinions or complaints raised by users and to handle compensation for damages.
The Mall shall prioritize handling complaints and opinions submitted by users. However, if prompt handling is difficult, the Mall shall immediately notify the user of the reasons and the processing schedule.
If a user applies for damage relief regarding disputes arising from electronic commerce between the Mall and the user, the Mall may comply with mediation by a dispute mediation institution requested by the Fair Trade Commission or the mayor/governor of the city/province.
Article 23 (Jurisdiction and Governing Law)
Lawsuits related to electronic commerce disputes between the Mall and users shall be under the exclusive jurisdiction of the district court having jurisdiction over the user's address at the time of filing. If the user has no address, the court with jurisdiction over the user's residence shall be the venue. However, if the user's address or residence is unclear or if the user resides abroad at the time of filing, the lawsuit shall be filed at the competent court according to the Civil Procedure Act.
Korean law shall apply to lawsuits arising between the Mall and users in electronic commerce matters.
